2,500 ballots to be inspected in suit by Arizona GOP chief

PHOENIX (AP) — County election officials agreed Wednesday to expand their inspection of certain ballots in metro Phoenix that are being challenged in a Republican lawsuit that seeks to reverse Joe Biden’s victory in the state.

Arizona Republican Party Chairwoman Kelli Ward, who filed a lawsuit contesting the election results, is looking for irregularities among the nearly 28,000 ballots in Maricopa County that were duplicated by elections officials because voters’ earlier ballots were damaged or couldn’t be tabulated. She requested a broader examination of the ballots after a court-ordered inspection of 100 duplicated ballots on Tuesday found two instances in which votes cast for Trump were cancelled in the duplication process.

Before the judge could rule on Ward’s request at a court hearing, the county offered to review 2,500 additional duplicated ballots.

“We put on a great election on Nov. 3, and we are happy to have people look more closely at it,” said Tom Liddy, a lawyer representing county officials. “We have nothing to hide.”

Ward’s lawyers say the inspection of 100 ballots found that one person’s vote for Trump was ultimately recorded as a Biden vote and that another person’s vote for Trump was cancelled when the reproduced ballot contained votes for both the Republican incumbent and a write-in candidate.

Bruce Spiva, a lawyer for the 11 Biden electors in Arizona who were sued by Ward, questioned whether the error rate for duplicated ballots would be so high that it could plausibly change how the state voted in the presidential race.

Roopali Desai, an attorney representing Democratic Secretary of State Katie Hobbs, said Ward’s lawsuit is a “fishing expedition” that doesn’t make any claims of pervasive fraud or intentional misconduct.

A trial has been scheduled for Thursday in Ward’s lawsuit.

The state’s election results were certified on Monday, showing Biden won Arizona by more than 10,000 votes. The Electoral College is scheduled to meet on Dec. 14.

No evidence of voter fraud or election fraud has emerged during this election season in Arizona. U.S. Attorney General Bill Barr has said the Justice Department has uncovered no evidence of widespread voter fraud that would change the outcome of the election.

Even though Republican Gov. Doug Ducey said earlier this week that Arizona’s election was well-run as he certified the Nov. 3 results, many GOP politicians in the state have mostly been silent or slow to express confidence in the election results that gave Biden a victory in Arizona.

Ward’s lawsuit claims some suburbs on the southeastern edge of Maricopa County had an unusually high number of duplicated ballots — and that the election results in that area were “strongly inconsistent” with voter registration and historical voting data. Hobbs’ office has said there were 104 duplicated ballots cast in the area in question.

Four earlier election challenges in Maricopa County were dismissed, including one filed by the Arizona Republican Party that sought to determine whether voting machines were hacked.

A new election challenge filed Wednesday by Trump’s electors in Arizona alleges that there were more than 400,000 illegal ballots counted in the state and criticizes the voting equipment used in metro Phoenix. The lawsuit was filed by firebrand conservative attorney Sidney Powell, who was removed from Trump’s legal team.

Project Veritas has released the results of an investigation into alleged ballot harvesting by supporters of Democrat Rep. Ilhan Omar in Minnesota, a key swing state in the 2020 presidential election.

Video footage captured by Project Veritas shows an operative, Liban Mohamed, bragging about collecting hundreds of ballots.

“Numbers do not lie. Numbers do not lie. … You can see my car is full. All these here are absentee ballots. Can’t you see? Look at all these; my car is full,” Mohamed can be heard saying in the video.

The video also includes testimony from a whistleblower, Omar Jamal, who called Rep. Omar’s alleged ballot harvesting an “open secret” and also discussed an alleged cash-for-votes scheme organized by staffers of Rep. Omar.

“She [Ilhan Omar] will do anything that she can do to get elected and she [Ilhan Omar] has hundreds of people on the streets doing that,” said Jamal.

James O’Keefe, the founder and CEO of Project Veritas, said, “Ballot harvesting is real, and it has become a big business. Our investigation into this ballot harvesting ring demonstrates clearly how these unscrupulous operators exploit the elderly and immigrant communities — and have turned the sacred ballot box into a commodities trading desk.”

O’Keefe said, “We are showing Americans what is really going on in one of our great cities — but, it is not me saying — we have the operatives on tape saying it all themselves.”

Project Veritas said its investigation found three locations inside Ward 6, a ballot harvesting triangle, where the scheme operates: The Riverside Plaza apartments, the senior citizen community at Horn Towers, and the Minneapolis Elections and Voter Services office at 980 E. Hennepin Ave., which also functions as a voting location and ballot drop-off site.

Jared Edge, the chief legal officer for Project Veritas, said that Mohamed and other ballot harvesters could face heavy penalties for their alleged violations of the law.

“The federal laws, 18 USC §597 and 52 USC §10307(c), are quite clear,” he said. “In the case of 18 USC §597, it is punishable by up to two years in prison and in the case of 52 USC §10307 it’s punishable by up to $10,000 in fines and up to five years in prison.”

The Minnesota statute 211B.13(1) prohibits paying a person or receiving money to register to vote or to vote, he said. “This is a state felony punishable by more than one-year imprisonment.”

Beyond paying voters, there are also state and federal laws regarding intimidation of voters, he said.

“The federal laws 52 USC §20511, 18 USC §594, and 52 USC §10307(b) and the Minnesota statue 211B.07 prohibit anyone from using undue influence, threats, intimidation, or fraud to influence a person’s vote or to influence them to vote at all,” he said.

“It is also a violation of federal law for anyone who votes for others illegally,” he said.

“The punishment under 52 USC §10307(e) also goes up to five years’ incarceration and a $10,000 fine,” he said.

“In addition to those statutes, Minnesota has another statute, 211B.11(3), which makes it a misdemeanor to induce or persuade a voter to vote for or against a candidate while transporting the voter to the polls,” he said.

Confessions of a voter fraud: I was a master at fixing mail-in ballots

A top Democratic operative says voter fraud, especially with mail-in ballots, is no myth. And he knows this because he’s been doing it, on a grand scale, for decades.

Mail-in ballots have become the latest flashpoint in the 2020 elections. While President Trump and the GOP warn of widespread manipulation of the absentee vote that will swell with COVID polling restrictions, many Democrats and their media allies have dismissed such concerns as unfounded.

But the political insider, who spoke on condition of anonymity because he fears prosecution, said fraud is more the rule than the exception. His dirty work has taken him through the weeds of municipal and federal elections in Paterson, Atlantic City, Camden, Newark, Hoboken and Hudson County and his fingerprints can be found in local legislative, mayoral and congressional races across the Garden State. Some of the biggest names and highest office holders in New Jersey have benefited from his tricks, according to campaign records The Post reviewed.

“An election that is swayed by 500 votes, 1,000 votes — it can make a difference,” the tipster said. “It could be enough to flip states.”

The whisteblower — whose identity, rap sheet and long history working as a consultant to various campaigns were confirmed by The Post — says he not only changed ballots himself over the years, but led teams of fraudsters and mentored at least 20 operatives in New Jersey, New York and Pennsylvania — a critical 2020 swing state.

“There is no race in New Jersey — from City Council to United States Senate — that we haven’t worked on,” the tipster said. “I worked on a fire commissioner’s race in Burlington County. The smaller the race the easier it is to do.”

A Bernie Sanders die-hard with no horse in the presidential race, he said he felt compelled to come forward in the hope that states would act now to fix the glaring security problems present in mail-in ballots.

“This is a real thing,” he said. “And there is going to be a f–king war coming November 3rd over this stuff … If they knew how the sausage was made, they could fix it.”

Mail-in voting can be complicated — tough enough that 84,000 New Yorkers had their mailed votes thrown out in the June 23 Democratic presidential primary for incorrectly filling them out.

But for political pros, they’re a piece of cake. In New Jersey, for example, it begins with a blank mail-in ballot delivered to a registered voter in a large envelope. Inside the packet is a return envelope, a “certificate of mail in voter” which the voter must sign, and the ballot itself.

That’s when the election-rigger springs into action.

Phony Ballots

The ballot has no specific security features — like a stamp or a watermark — so the insider said he would just make his own ballots.

“I just put [the ballot] through the copy machine and it comes out the same way,” the insider said.

But the return envelopes are “more secure than the ballot. You could never recreate the envelope,” he said. So they had to be collected from real voters.

He would have his operatives fan out, going house-to-house, convincing voters to let them mail completed ballots on their behalf as a public service. The fraudster and his minions would then take the sealed envelopes home and hold them over boiling water.

“You have to steam it to loosen the glue,” said the insider.

He then would remove the real ballot, place the counterfeit ballot inside the signed certificate, and reseal the envelope.

“Five minutes per ballot tops,” said the insider.

The insider said he took care not to stuff the fake ballots into just a few public mailboxes, but sprinkle them around town. That way he avoided the attention that foiled a sloppy voter-fraud operation in a Paterson, NJ city council race this year, where 900 ballots were found in just three mailboxes.

“If they had spread them in all different mailboxes, nothing would have happened,” the insider said.

Inside Jobs

The tipster said sometimes postal employees are in on the scam.

“You have a postman who is a rabid anti-Trump guy and he’s working in Bedminster or some Republican stronghold … He can take those [filled-out] ballots, and knowing 95% are going to a Republican, he can just throw those in the garbage.”

In some cases, mail carriers were members of his “work crew,” and would sift ballots from the mail and hand them over to the operative.

In 2017 more than 500 mail-in ballots in New York City never arrived to the Board of Elections for races that November — leaving hundreds disenfranchised. They eventually were discovered in April 2018. “For some undetermined reason, some baskets of mail that were bound to the New York City Board of Elections were put off to the side at the Brooklyn processing facility,” city elections boss Michael Ryan said at the time of discovery.

Nursing Homes

Hitting up assisted-living facilities and “helping” the elderly fill out their absentee ballots was a gold mine of votes, the insider said.

“There are nursing homes where the nurse is actually a paid operative. And they go room by room by room to these old people who still want to feel like they’re relevant,” said the whistleblower. “[They] literally fill it out for them.”

The insider pointed to former Jersey City Mayor Gerald McCann, who was sued in 2007 after a razor-thin victory for a local school board seat for allegedly tricking “incompetent … and ill” residents of nursing homes into casting ballots for him. McCann denied it, though did admit to assisting some nursing home residents with absentee ballot applications.

Voter Impersonation

When all else failed, the insider would send operatives to vote live in polling stations, particularly in states like New Jersey and New York which do not require voter ID. Pennsylvania, also for the most part, does not.

The best targets were registered voters who routinely skip presidential or municipal elections — information which is publicly available.

“You fill out these index cards with that person’s name and district and you go around the city and say, ‘You’re going to be him, you’re going to be him,” the insider said of how he dispatched his teams of dirty-tricksters.

At the polling place, the fake voter would sign in, “get on line and … vote,” the insider said. The imposters would simply recreate the signature that already appears in the voter roll as best they could. In the rare instance that a real voter had already signed in and cast a ballot, the impersonator would just chalk it up to an innocent mistake and bolt.

Bribing voters

The tipster said New Jersey homeless shelters offered a nearly inexhaustible pool of reliable — buyable — voters.

“They get to register where they live in and they go to the polls and vote,” he said, laughing at the roughly $174 per vote Mike Bloomberg spent to win his third mayoral term. He said he could have delivered the same result at a 70-percent discount — like when Frank “Pupie” Raia, a real estate developer and Hoboken nabob, was convicted last year on federal charges for paying low-income residents 50 bucks a pop to vote how he wanted during a 2013 municipal election.

Organizationally, the tipster said his voter-fraud schemes in the Garden State and elsewhere resembled Mafia organizations, with a boss (usually the campaign manager) handing off the day-to-day managing of the mob soldiers to the underboss (him). The actual candidate was usually kept in the dark deliberately so they could maintain “plausible deniability.”

With mail-in ballots, partisans from both parties hash out and count ballots at the local board of elections — debating which ballots make the cut and which need to be thrown out because of irregularities.

The insider said any ballots offered up by him or his operation would come with a bent corner along the voter certificate — which contains the voter signature — so Democratic Board of Election counters would know the fix was in and not to object.

“It doesn’t stay bent, but you can tell it’s been bent,” the tipster said. “Until the [certificate] is approved, the ballot doesn’t matter. They don’t get to see the ballot unless they approve the [certificate.]”

“I invented bending corners,” the insider boasted, saying once the fixed ballots were mixed in with the normal ones, the bed was made. “Once a ballot is opened, it’s an anonymous ballot.”

While federal law warns of prison sentences of up to five years, busted voter frauds have seen far less punishment. While in 2018 a Texas woman was sentenced to five years, an Arizona man busted for voting twice in the mail was given just three years probation. A study by the conservative Heritage Foundation found more than 1,000 instances of documented voter fraud in the United States, almost off of which occurred over the last 20 years.

“There is nothing new about these techniques,” said Hans von Spakovsky, a senior legal fellow at Heritage who manages their election law reform initiative. “Everything he’s talking about is perfectly possible.“

The city Board of Elections declined to answer Post questions on ballot security.

New Jersey Attorney General Gurbir Grewal has filed voter fraud charges against four men, including two Paterson City officials, who allegedly engaged in a mail-in ballot scheme during a special election last month.

Grewal charged Paterson City Councilman Michael Jackson, Councilman-elect Alex Mendez, and two other men after the U.S. Postal Inspection Service alerted the state attorney general’s office that it had found hundreds of ballots in a single Paterson City mailbox, InsiderNJ reported.

According to WNBC-TV, more than 3,000 ballots were set aside over voting fraud concerns in the Paterson City Council election — 16,747 were received, but only 13,557 were accepted — meaning a whopping 19%, or nearly 1-in-5, were rejected.

More than 800 of the rejected ballots were invalidated because they were found tethered together in mailboxes.

The alleged voter fraud is particularly significant in the election because one incumbent councilman kept his seat by just eight votes, while Mendez was elected by fewer than 250 votes, WNBC reported.

Jackson was charged with four crimes, including fraud in casting mail-in vote and falsifying records. From the attorney general’s office:

It is alleged that Jackson violated state election laws as a candidate by approaching one or more voters in Paterson in the district where he was running and collecting their official mail-in ballots for delivery to the Passaic County Board of Elections. It is further alleged that these mail-in ballots were delivered to the Board of Elections without information identifying the bearer, in violation of state election laws. In addition, Jackson allegedly procured and had in his possession more than three official mail-in ballots which were neither his own ballots, nor ballots for which he was identified as an authorized bearer. Lastly, Jackson allegedly received the official mail-in ballot of one voter without the ballot having been voted or sealed, and that ballot was subsequently delivered to the Board of Elections in a sealed envelope without information identifying the bearer.

Mendez was hit with six criminal charges, including election fraud and falsifying records. From the Attorney General’s Office:

It is alleged that Mendez violated state election laws as a candidate by approaching one or more voters in Paterson in the district where he was running and collecting their official mail-in ballots for delivery to the Passaic County Board of Elections. It is further alleged that these mail-in ballots were delivered to the Board of Elections without information identifying the bearer in violation of state election laws. In addition, Mendez allegedly procured or submitted one or more voter registration applications, which he knew to be false, fictitious, or fraudulent, in that he knew the person for whom the application was procured was not eligible to vote in the election district identified on the application.

“Today’s charges send a clear message: if you try to tamper with an election in New Jersey, we will find you and we will hold you accountable,” Grewal said. “We will not allow a small number of criminals to undermine the public’s confidence in our democratic process.”

According to the Paterson Times, Jackson faces more than 10 years in prison while Mendez faces more than 31 years in prison.

The charges were filed as Democrats nationwide push for mail-in voting as a method to reduce coronavirus spread. Republicans generally oppose mail-in voting, arguing it opens the door to voter fraud.

Attorneys for Senator-elect Rick Scott, the National Republican Senate Committee and the Republican Party of Palm Beach County descended on Palm Beach County’s Supervisor of Elections office on Friday night to oversee the vote counting that could decide the outcome of key Florida races.

Democratic candidates Bill Nelson and Andrew Gillum have their own team of attorneys watching the canvassing board closely, looking for anything that could change the result of the elections and snatch the Senate and Gubernatorial wins from exiting Governor Rick Scott and newly elected Governor Ron DeSantis. Apparently, that includes counting non-U.S. citizens’ votes.


Among the crowd of dedicated observers who remained past midnight was Michael Barnett, the chairman of the Palm Beach County Republican Party. Barnett sent BizPac Review part of the transcript from the proceedings showing attorneys for both Gillum and Nelson objecting to tossing out a non-citizen vote.

Susan Bucher, the election supervisor of Palm Beach County, rightfully called the ballot as “not counted,” but not without objection from both Gillum and Nelson’s attorneys.

Voting machines in more than one-third of all Detroit precincts registered more votes than they should have during last month’s presidential election, according to Wayne County records prepared at the request of The Detroit News.

Detailed reports from the office of Wayne County Clerk Cathy Garrett show optical scanners at 248 of the city’s 662 precincts, or 37 percent, tabulated more ballots than the number of voters tallied by workers in the poll books. Voting irregularities in Detroit have spurred plans for an audit by Michigan Secretary of State Ruth Johnson’s office, Elections Director Chris Thomas said Monday.

The Detroit precincts are among those that couldn’t be counted during a statewide presidential recount that began last week and ended Friday following a decision by the Michigan Supreme Court.

Democrat Hillary Clinton overwhelmingly prevailed in Detroit and Wayne County. But Republican President-elect Donald Trump won Michigan by 10,704 votes or 47.5 percent to 47.3 percent.

Overall, state records show 10.6 percent of the precincts in the 22 counties that began the retabulation process couldn’t be recounted because of state law that bars recounts for unbalanced precincts or ones with broken seals.

The problems were the worst in Detroit, where discrepancies meant officials couldn’t recount votes in 392 precincts, or nearly 60 percent. And two-thirds of those precincts had too many votes.

Republican state senators last week called for an investigation in Wayne County, including one precinct where a Detroit ballot box contained only 50 of the 306 ballots listed in a poll book, according to an observer for Trump.

Detroit elections officials waited several days to deliver nearly 100 poll books to Wayne County officials charged with certifying the presidential election, newly released documents show.

County clerk officials on Thursday released a memo to State Elections Director Chris Thomas that said 95 poll books from the 662 precincts weren’t available at the start of the canvass, which began the day after the Nov. 8 election. Five of those poll books, which contain the names of voters and ensure the integrity of elections, were never delivered to county canvassers and presumably remain missing.

The memo from county elections official Jennifer Redmond to the state also shows poll books in 101 Detroit precincts were not delivered in sealed envelopes, as the law requires.

Separate county documents obtained by The News show that poll books in 17 precincts were missing seal numbers from ballot boxes, as is required by state law.

Another Detroit precinct contained 50 of the 306 ballots listed in a poll book, according to an observer for Trump.

Could non-citizens decide the November election?

Could control of the Senate in 2014 be decided by illegal votes cast by non-citizens? Some argue that incidents of voting by non-citizens are so rare as to be inconsequential, with efforts to block fraud a screen for an agenda to prevent poor and minority voters from exercising the franchise, while others define such incidents as a threat to democracy itself. Both sides depend more heavily on anecdotes than data.

In a forthcoming article in the journal Electoral Studies, we bring real data from big social science survey datasets to bear on the question of whether, to what extent, and for whom non-citizens vote in U.S. elections. Most non-citizens do not register, let alone vote. But enough do that their participation can change the outcome of close races.

Our data comes from the Cooperative Congressional Election Study (CCES). Its large number of observations (32,800 in 2008 and 55,400 in 2010) provide sufficient samples of the non-immigrant sub-population, with 339 non-citizen respondents in 2008 and 489 in 2010. For the 2008 CCES, we also attempted to match respondents to voter files so that we could verify whether they actually voted.

How many non-citizens participate in U.S. elections? More than 14 percent of non-citizens in both the 2008 and 2010 samples indicated that they were registered to vote. Furthermore, some of these non-citizens voted. Our best guess, based upon extrapolations from the portion of the sample with a verified vote, is that 6.4 percent of non-citizens voted in 2008 and 2.2 percent of non-citizens voted in 2010.

Because non-citizens tended to favor Democrats (Obama won more than 80 percent of the votes of non-citizens in the 2008 CCES sample), we find that this participation was large enough to plausibly account for Democratic victories in a few close elections. Non-citizen votes could have given Senate Democrats the pivotal 60th vote needed to overcome filibusters in order to pass health-care reform and other Obama administration priorities in the 111th Congress. Sen. Al Franken (D-Minn.) won election in 2008 with a victory margin of 312 votes. Votes cast by just 0.65 percent of Minnesota non-citizens could account for this margin. It is also possible that non-citizen votes were responsible for Obama’s 2008 victory in North Carolina. Obama won the state by 14,177 votes, so a turnout by 5.1 percent of North Carolina’s adult non-citizens would have provided this victory margin.

We also find that one of the favorite policies advocated by conservatives to prevent voter fraud appears strikingly ineffective. Nearly three quarters of the non-citizens who indicated they were asked to provide photo identification at the polls claimed to have subsequently voted.

An alternative approach to reducing non-citizen turnout might emphasize public information. Unlike other populations, including naturalized citizens, education is not associated with higher participation among non-citizens. In 2008, non-citizens with less than a college degree were significantly more likely to cast a validated vote, and no non-citizens with a college degree or higher cast a validated vote. This hints at a link between non-citizen voting and lack of awareness about legal barriers.

There are obvious limitations to our research, which one should take account of when interpreting the results. Although the CCES sample is large, the non-citizen portion of the sample is modest, with the attendant uncertainty associated with sampling error. We analyze only 828 self-reported non-citizens. Self-reports of citizen status might also be a source of error, although the appendix of our paper shows that the racial, geographic, and attitudinal characteristics of non-citizens (and non-citizen voters) are consistent with their self-reported status.

Another possible limitation is the matching process conducted by Catalist to verify registration and turnout drops many non-citizen respondents who cannot be matched. Our adjusted estimate assumes the implication of a “registered” or “voted” response among those who Catalist could not match is the same as for those whom it could. If one questions this assumption, one might focus only on those non-citizens with a reported and validated vote. This is the second line of the table.

Finally, extrapolation to specific state-level or district-level election outcomes is fraught with substantial uncertainty. It is obviously possible that non-citizens in California are more likely to vote than non-citizens in North Carolina, or vice versa. Thus, we are much more confident that non-citizen votes mattered for the Minnesota Senate race (a turnout of little more than one-tenth of our adjusted estimate is all that would be required) than that non-citizen votes changed the outcome in North Carolina.

Our research cannot answer whether the United States should move to legalize some electoral participation by non-citizens as many other countries do, and as some U.S. states did for more than 100 years, or find policies that more effectively restrict it. But this research should move that debate a step closer to a common set of facts.
