Alexandria Ocasio-Cortez falsely says, “They had to amend the Constitution of the United States to make sure Roosevelt did not get reelected”

Alexandria Ocasio-Cortez recently said that the 22nd amendment to the U.S. Constitution was passed in order to prevent U.S. president Franklin D. Roosevelt from getting reelected. You can see her saying it in this video:

Here are her exact words:

“They had to amend the Constitution of the United States to make sure Roosevelt did not get reelected.”

Here are two reasons why Ocasio-Cortez’s statement is wrong.

First of all, Roosevelt died two years before the 22nd amendment was approved by the U.S. Congress. Roosevelt died in 1945. The U.S. Congress approved the 22nd amendment in 1947.

Secondly, the 22nd amendment contains a clause which gives an exemption to whoever is President at the time the amendment is passed. This is the text of the 22nd amendment: (The bolding mine.)

Section 1. No person shall be elected to the office of the President more than twice, and no person who has held the office of President, or acted as President, for more than two years of a term to which some other person was elected President shall be elected to the office of the President more than once. But this Article shall not apply to any person holding the office of President when this Article was proposed by the Congress, and shall not prevent any person who may be holding the office of President, or acting as President, during the term within which this Article becomes operative from holding the office of President or acting as President during the remainder of such term.

Section 2. This Article shall be inoperative unless it shall have been ratified as an amendment to the Constitution by the legislatures of three-fourths of the several states within seven years from the date of its submission to the states by the Congress.

So that”s two different reasons why Ocasio-Cortez’s statement is wrong.

    “According to the National Constitution Center, discussion of the 22nd Amendment and a term limit began in 1944 after presidential candidate Thomas Dewey warned a ā€œ16-year term for Roosevelt was a threat to Democracy.ā€

    Roosevelt died while in office in 1945 and the 22nd Amendment was proposed by Congress in 1947.”

    1947 was when Republicans took control of both the House and Senate to begin making the two-term limit a reality, the discussion of which began while Roosevelt was in his third term running for a fourth.

      The 22nd amendment was passed two years after FDR died. It also includes an exemption for the sitting president.

        Need I repeat that the discussion of a two-term presidency began with the Republicans while FDR was in his third term, which is exactly what she was referring to, even if she wasn’t precise in her chronology. By the way, why aren’t you complaining about FOX News and their reporting of Trump cutting aid money to “three Mexican countries”? Right wingers just love to nitpick the left’s verbal fumbles while overlooking their own verbal foibles. Try picking on bigger fish to fry than this minuscule nonsense your side is blowing out of proportion – it’s not like she’s running, nor can, for president in 2020.
